Status of the Convention

 

Signature and ratification

In accordance with Article 36 paragraph 1 the Convention closed for signature on 31 January 2011.

Article 36 paragraph 2 provides that the Convention is subject to ratification, acceptance or approval by the signatories and Article 36 paragraph 3 provides that instruments of ratification, acceptance or approval shall be deposited with the Depositary.

Accession

Article 37 paragraph 1 provides that the Convention shall be open for accession, after its closure for signature, by any State, regional economic integration organisation or other entity referred to in Article 36 paragraph 1, and by any other State or any other entity referred to in Article 1 paragraph 2 (b) having an interest in fishery resources.

Article 37 paragraph 2 provides that instruments of accession shall be deposited with the Depositary.

Entry into force

Article 38 paragraph 1 provides that the Convention shall enter into force 30 days after the date of the receipt by the Depositary of the eighth instrument of ratification, accession, acceptance or approval, which shall include ratification, accession, acceptance or approval by:

(a) At least three coastal States adjacent to the Convention Area, which must include representation from both the sides of the Convention Area that is east of Meridian 120˚ West and the side of the Convention Area that is west of Meridian 120˚ West; and

(b) At least three States that are not coastal States adjacent to the Convention Area and whose fishing vessels are fishing in the Convention Area or have fished in the Convention Area.

Article 38 paragraph 5 provides that for the purposes of this Article, "fishing" includes only the activities described in Article 1 paragraph 1 (g) (i) and (ii).

Article 38 paragraph 2 provides that if within three years of its adoption, this Convention has not entered into force in accordance with paragraph 1, it shall enter into force six months after the deposit of the tenth instrument of ratification, accession, acceptance or approval, or in accordance with paragraph 1, whichever is the earlier.

On 31 January 2011 a representative of Chinese Taipei deposited an Instrument for the Participation of Fishing Entities dated 17 January 2011.The Instrument records that Chinese Taipei, as a fishing entity, agrees, subject to a subsequent written confirmation of the fulfilment of its legal requirements, to express its intent to be bound by the regime established by the Convention in accordance with Annex IV of the Convention.

 

States, regional economic integration organisation and entities that wish to deposit instruments of ratification, accession, acceptance or approval in relation to the Convention should contact the Legal Division of the New Zealand Ministry of Foreign Affairs and Trade to make the relevant arrangements.
